The TN Act has also set up a Tamil Nadu Online Gaming Authority (“TNOGA”) for implementing some of its provisions. The implementation of the TN Act was, however, in abeyance, given that there were some pending challenges to the constitutionality of the legislation. After lengthy hearings, the Madras High Court upheld the validity of the TN Act in the case of All India Gaming Federation v. State of Tamil Nadu & Others. While the Madras High Court upheld the constitutional validity of the TN Act, it struck down the Schedule that classified rummy and poker as games of chance, noting that the Supreme Court had previously recognised rummy as a game of skill. Currently, the State of Tamil Nadu has filed a special leave petition before the Supreme Court challenging this portion of the judgment, which remains pending adjudication.

Despite the New Act’s enactment, no enforcement date has been notified, and several petitions have been filed challenging its constitutionality.

There are specific exemptions for games of skill under most State Gaming Laws and courts have also recognised offering of skill games as a legitimate business activity that is constitutionally protected. No licence is required for offering skill games in most states in India except Sikkim and Nagaland, which have licensing regimes for skill games under the respective Acts. Betting on horse races has been judicially recognised as a game of skill, and many State Gaming Laws also expressly exclude it from their prohibitions – subject to certain conditions. Since most of the governing statutes are pre-internet, there is no specific regulator or statutory language in most State Gaming Laws for online betting on horse races. However, the race club organising the horse race may impose certain conditions. The main legal difference is whether an activity is a “game of skill” or a “game of chance.” Games of skill are usually allowed, but games of chance are often banned in many states due to gambling laws.

Once finalised, the Draft Rules will give effect to the provisions of the New Act. However, a few categories like horse racing and lotteries are an exception to this. Gambling in India is a state subject which means that only the state governments are entitled to formulate and govern such activities for their own states. The Public Gambling Act 1867 also known as the Gambling Act is the general law that governs gambling in India.

The central government is reportedly in the advanced stages of finalising a proposal to bring online real-money gaming companies under the ambit of the PMLA. In India, the legislative powers are divided between the centre and the states under the Constitution of India, 1950 (“Constitution”). Under its Seventh Schedule, the Constitution grants each state (province) of the country the exclusive power to enact its own laws on “betting and gambling” for its own territory.

  • Today, when demonetisation is the order of the day, the above measures would go a long way in curbing black money, corruption, and current ill effects of casinos and building up a transparent and growth friendly gambling system for a healthy and ever growing economy.
  • The main legal difference is whether an activity is a “game of skill” or a “game of chance.” Games of skill are usually allowed, but games of chance are often banned in many states due to gambling laws.
  • Needless to say, Roobet is legal in India for having a licence and its offshore setup.
  • Some activities, like fantasy sports and horse racing, have legal protection.

How does the legality of gambling in India differ between physical casinos and online platforms?

While betting laws in India are strict, several popular games continue to attract players through both legal and unofficial channels. He has worked for a few online casino operators in customer support, management and marketing roles since 2020. His few years of hands-on experience in casino operation and expertise in the iGaming industry help see through the qualities of online gambling sites and create honest reviews.

The Khelo24Bet tax on the income earned by Mr. X through gambling is thirty percent along with a surcharge of ten per cent on the above tax. “Two agencies have come forward to run offshore casinos on the lines of those in Goa but we are treading cautiously. A move to launch casinos may generate opposition since the state has already banned lottery and gambling. In the next few days, we will discuss legalizing offshore casinos” he said. In December 2015, the Home Department of India drafted a new set of laws that seek to ban local residents visiting casinos, raise the gambling age to 21 and require identification to be presented upon entry to a casino. The bill requires approval by the Goa government before it is implemented in whole or in part.

States like Andhra Pradesh and Telangana have implemented strict laws against all forms of online gambling, including skill-based games.
